1. Acceptance of Terms

By accessing or using any website, newsletter, coaching program, consulting engagement, or digital or physical product offered by Discover Dyflin LLC ("Discover Dyflin," "we," "us," "our"), you ("you," "User," or "Customer") agree to be bound by these Terms of Service ("Terms"). If you do not accept all provisions herein, do not access or use our services.

2. Services We Provide

  • Fractional RevOps & Sales Enablement Consulting – Retainer-based advisory and hands-on operational work delivered to businesses.

  • Coaching Programs – Group or 1-to-1 sessions delivered online.

  • Newsletter & Digital Publications – "Beyond Strategy & Stardust" and related written content distributed via Substack and other channels.

  • Digital & Physical Products – The Curious Grove coloring books and related printable or physical goods, workbooks, templates, and other downloadable content.

We reserve the right to modify, suspend, or discontinue any service component at any time.

3. Eligibility & User Obligations

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to contract. Products intended for children (e.g., Curious Grove coloring books) may be purchased by, and used under the supervision of, a parent or guardian.

You agree to provide accurate, current information and keep it updated.

You will not:

  • Violate any laws or regulations while using our services;

  • Share, resell, or exploit consulting deliverables, coaching materials, or products without written permission;

  • Upload malicious code or interfere with the Site's security.

4. Account Registration & Security

Some features require a user account (e.g., newsletter subscription, client portal access). You are responsible for:

  • Maintaining confidentiality of login credentials;

  • All activities that occur under your account;

  • Notifying us immediately of unauthorized use. We are not liable for losses due to stolen credentials.

5. Intellectual Property Rights

All content, logos, trademarks, writing, artwork, and materials provided by Discover Dyflin (including The Curious Grove characters, illustrations, and coloring book content) ("Content") are owned by Discover Dyflin or its licensors and protected by U.S. and international IP laws. We grant you a limited, revocable, non-transferable license to access and use the Content for your personal or internal, non-commercial purposes. Physical and digital products (e.g., coloring books) are licensed for personal/household use only. You may not modify, distribute, reproduce, resell, or create derivative works from our Content without our written consent.

6. Payment, Pricing & Refund Policy

  • Currency & Processing: Prices are listed in U.S. dollars and processed via Stripe or other authorized payment processors.

  • Billing: You authorize us to charge your payment method for fees selected at checkout or agreed in a signed engagement, including applicable taxes.

  • Consulting & Coaching: Retainer and coaching fees are governed by the applicable signed agreement or statement of work, including its own notice, term, and early-termination provisions.

  • Digital Products: All sales of digital products (including Curious Grove digital downloads, workbooks, templates, and other downloadable content) are final. No refunds will be issued once a digital product has been delivered or made accessible.

  • Coaching: For paid coaching sessions, you may request a full refund within 14 days of purchase by emailing [your business email], provided the session(s) have not yet been performed. No refunds are available once a coaching session has taken place.

  • No refunds for consulting retainers, custom work already performed, or physical products once shipped.

  • Chargebacks: Filing a chargeback without first contacting support may result in account suspension.

7. Educational & Earnings Disclaimer

Discover Dyflin provides educational, advisory, and creative information and services only. We make no guarantees of specific business results, revenue growth, or operational outcomes from our consulting, coaching, or published content. Your outcomes depend on numerous factors beyond our control.

8. Third-Party Services

Our services may integrate with, or contain links to, third-party platforms (e.g., Substack, Zoom, Stripe, Google Workspace, Amazon KDP, social media platforms). We are not responsible for third-party terms, privacy practices, or content. Your use of third-party services is at your own risk and governed by their respective agreements.

9. Warranty Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

To the fullest extent permitted by law, Discover Dyflin's total liability for any claim arising out of these Terms or your use of the services will not exceed the amount you paid to Discover Dyflin in the 12 months preceding the event giving rise to liability—or USD $500, whichever is greater. We are not liable for indirect, incidental, special, consequential, or exemplary damages (including lost profits, goodwill, or data).

11. Indemnification

You agree to indemnify, defend, and hold harmless Discover Dyflin, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising out of your:

  • Breach of these Terms;

  • Misuse of the services;

  • Violation of any law or third-party right.

12. Arbitration & Governing Law

  • Binding Arbitration: Any dispute arising under these Terms will be resolved by confidential, binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

  • Venue: The seat of arbitration will be Austin TX, USA, unless the parties agree otherwise.

  • Class Action Waiver: Disputes will be arbitrated only on an individual basis; class or representative actions are not permitted.

  • Governing Law: These Terms are governed by the laws of the State of [your state], excluding conflict-of-law principles.

13. Modifications to Terms

We may revise these Terms at any time. Material changes will be posted on the Site or emailed to registered users/subscribers. Continued use after changes take effect constitutes acceptance.

14. Severability & Entire Agreement

If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary; the remainder will remain in full force. These Terms constitute the entire agreement between you and Discover Dyflin regarding the services and supersede any prior agreements, except where superseded by a signed consulting or coaching agreement between the parties.
